Terms & Conditions

1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the XWheels Operator Portal ("Platform"), operated by Rarticle Software Sdn. Bhd. ("Company"). By registering for an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Eligibility

  • You must be at least 18 years old.
  • You must hold a valid Malaysian phone number for account verification.
  • If registering on behalf of a business entity, you must have the authority to bind that entity to these Terms.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Provide accurate and complete registration information.
  • Keep your password secure and not share it with others.
  • Notify us immediately of any unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

4. Platform Services

The Platform provides operators with tools to:

  • List and manage rental vehicles
  • Manage customer/renter records
  • Create and track bookings
  • Monitor business performance and earnings

The Platform is a management tool. XWheels does not act as a rental company, insurance provider, or intermediary between operators and renters. All rental agreements, pricing, and liability remain solely between the operator and their customers.

5. Operator Responsibilities

As an operator, you agree to:

  • Ensure all vehicle listings are accurate and reflect the true condition, availability, and pricing of your vehicles.
  • Comply with all applicable Malaysian laws and regulations relating to vehicle rental, insurance, road transport, and consumer protection.
  • Maintain valid road tax, insurance, and Puspakom inspection for all listed vehicles as required by law.
  • Not use the Platform for any illegal, fraudulent, or harmful purpose.
  • Treat customer data in accordance with the Malaysian Personal Data Protection Act 2010 (PDPA).

6. Content & Intellectual Property

You retain ownership of the content you upload (vehicle photos, descriptions, customer records). By uploading content, you grant us a limited licence to store, display, and process it solely for the purpose of providing the Platform services.

The XWheels name, logo, and Platform design are the intellectual property of Rarticle Software Sdn. Bhd. You may not reproduce, distribute, or create derivative works from our branding or Platform without prior written permission.

7. Fees & Payments

XWheels charges a flat commission of 10% on completed bookings, automatically deducted from operator payouts. No setup fees or monthly subscriptions apply. Should pricing change in the future, we will provide at least 30 days' notice before any changes take effect. Continued use of the Platform after the notice period constitutes acceptance of the new pricing.

8. Data Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • The Platform is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
  • We are not responsible for disputes between operators and their customers.
  • Our total liability to you shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

10. Account Suspension & Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. You may delete your account at any time by contacting us. Upon deletion, your data will be removed in accordance with our Privacy Policy.

11. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated via the Platform or email at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Malaysian courts.
